Terms and conditions operator - 27

 

GENERAL TERMS


The following words shall, unless otherwise stated or inconsistent with the context in which they appear, bear the following meanings and other words derived from the same origins as such words (that is, cognate words) shall bear corresponding meanings:

“Arrangement(s)” means travel (subject to availability) on any departure date falling between the Start Date and End Date;
“Booking(s)” means any booking(s) of arrangements made or to be made by the Passenger with the Company under these terms and conditions;
“Company” shall be THE OPERATOR, operating the luxury yacht ;
“Agreement” shall mean these General Terms and Conditions;
“Passenger” means the person(s) or any of them who purchase any arrangement(s) or on whose behalf any Arrangement(s) is/are purchased;


1. CONTRACT


Passengers booking a cruise must complete, sign, and forward the Booking Form with payment of the deposit. A contract exists between said Passenger (hereinafter “the Passenger”) and the Company once the contract booking and deposit are confirmed. Under this contract the Passenger confirms that they read, understand, and agree to the terms and conditions (the "Terms and Conditions").  

2. RATES


The rates shown are in US Dollars for a six-night cruise.

Included: Accommodation with en-suite bathrooms, all meals, selected regional wines and alcoholic beverages carried on board, all sightseeing tours and admittance fees as stipulated on our website, use of the vessels' bicycles and other facilities, and round-trip transfers from the specified meeting point in either Paris or Geneva.

Not Included: Air transportation, airport taxes, visas, health or accident insurance, trip cancellation insurance, superior Chateaux vintage wines, optional activities not included in the itinerary, communication charges, 10% crew gratuity or purchases.

3. DEPOSIT AND FINAL PAYMENT


The Company will "hold" a Charter/Cabin Booking date on option for up to 14 days pending payment of the deposit. If the deposit remains unpaid beyond 14 days the option may be released without notice.
4.1 An initial 25% deposit of the total fare is payable at the time of booking.
4.2 The balance of the total fare is payable 90 days prior to departure.
4.3 Payments can be made via wire transfer, credit card, or check.

4. CANCELLATIONS AND REFUNDS


All payments are non-refundable.

5. NON·SMOKING POLICY


A strict non-smoking policy applies in the accommodation area of the vessel. Those passengers who wish to smoke must do so outdoors on the deck areas.

6. SPECIAL DIETS


Please notify us of any dietary requirements. We will make every effort to change the menu accordingly.

 

7. CHILDREN


Children welcome on full charter cruises.

8. PETS


Small dogs permitted on board for full charter cruises only. We do operate with a small (hypoallergenic) dog on board as a Captain’s pet. Passengers with dog related allergies should declare this on the Booking Form. We cannot accept liability for any reactions from undeclared allergies.

9. TRAVEL INSURANCE


Adequate travel insurance is recommended.

10. LIMITS OF RESPONSIBILITY


The Passenger further understands and agrees that the Company is not liable or responsible for the following:


a) Any personal injury, death, property damage or loss occasioned by theft, vandalism, fire, water, weather conditions, explosion, or any cause whatsoever, whether foreseeable or unforeseeable or in connection with the acts or omissions, whether negligent or intended of any third party; and
b) Any event which is beyond the control of the Company, including but not limited to loss of luggage, Acts of God, strikes, lockouts, work stoppages, riots, floods, government acts, terrorism, acts of war, criminal activity, Passenger illness, vessel damage, canal closures or repairs.

11. CRUISE ROUTES


Routes and vessel alterations and substitutions: All routes are subject to change without notice. Some waterways may be subject to occasional closures due to drought, storms, floods, canal or lock repairs, or other unforeseen circumstances that result in conditions unsafe for navigation. In the unlikely event of such occurrences, the following conditions shall apply:


a) If navigation must be suspended, passengers will continue to be accommodated on the stationary vessel and the planned excursions will continue.
b) The Company reserves the right to reverse a cruise route or cruise another waterway.

12. LAW AND JURISDICTION


These terms and conditions are subject to United States law. The State of Florida Court of Justice shall have exclusive jurisdiction to determine any dispute.
